110718 JYJ Members Expressed Their Feelings With Regards To Performance’s Cancellation‏

JYJ members revealed their feeling with regards to cancellation of their performance in KBS “Wish for 7 Wonders – KBS Special 5 Live”. Representative company CJeS Entertainment stated that Jeju’s honorary ambassador JYJ was slated to perform 2 songs at the “Wish for 7 Wonders – KBS Special 5 Live” and to go through the ambassador appointment ceremony on the 20th, but they received the broadcast cancellation notice on the 16th.

JYJ Kim Jaejoong tweeted on the 16th with, “If there are going to be obstacles blocking us from promoting our nation’s natural wonder, then this time, I’ll just promote it alone (like this).” He tweeted again on the wee hours of the morning on 18th with, “I don’t believe that the 7 Natural Wonders of the World Declaration Committee chooses beautiful locations in the world as a means of publicity for the profit and losses of a specific nation. Finding beautiful things in the world is a “happiness” that everyone in the world shares. Wouldn’t the purpose of choosing these natural wonders be to preserve them for a long time? But if there are complicated conditions existing beyond this significance, then the simpleness ..of everyone finding happiness will not be a smooth road.” Kim Junsu also expressed on his Twitter, “We cross mountain after mountain.. but ahead looms another one” and “Why are you all sorry.. we’re the ones who should be sorry”

(T/N: all tweet translations are credited to dongbangdata.net)

CJeS Entertainment stated through their homepage that JYJ was supposed to be appointed as ambassadors through the Special broadcast but with Jeju’s local government proceeding with the promotional activities, they (CJeS) officially announced their stance that “In this situation where there are no negotiations with the artistes and performance was one-sidedly canceled just four days before, we will file a complaint to Korea Fair Trade Commission.” CJeS Entertainment has yet to hear any response from Jeju’s local government or KBS Jeju.

On the other hand, KBS had ever stated in their homepage’s message board regarding JYJ’s unability to perform on KBS Music Bank that it is due to the on-going lawsuit between JYJ and ex-company SM Entertainment and yet contracted with current representative company. They also stated, “The continuation of allowing JYJ to perform would cause legal problems and damage the cultural development and order. Until the judgment between JYJ and their company is passed or a mutual agreement is agreed upon, broadcasting activities will be stopped as what was stated before and would be further discussed depending on the judgment.” They further explained that, “The stance before the judgment of invalidity of the contract was a mistake in our management.”

(T/N: This refers to KBS’s change of stance stating that “the previous ‘restriction’ stance was in February.” They later on released another statement that JYJ would be able to appear when they release a new album since JYJ did not released an album since February.)

110718 Has JYJ Became The Symbol Of Injustice?‏

Before the commence of JYJ’s topic, there are a few preconditional claims that have to be announced. This is because although the topic that I want to discuss starts with JYJ but the gist of the whole topic is not just about JYJ.

(JaeTime’s T/N: It meant that the discussion and thoughts from the commotion with regards to Korean entertainment agencies and unfair law judgment through the regrouping of JYJ and the lawsuit dispute.)

Preconditional Claim 1: JYJ are idols
JYJ is a new group formed comprising of TVXQ’s Xiah Junsu, Micky Yoochun and Hero Jaejoong, who left the group. TVXQ has attained the highest spot in the idol industry. This is a status achieved by all members of TVXQ and as an idol, they have their significance and their appearance would meant a significant meaning. Of course at the same time where they have their group of loyal fans, anti-fans would be present as well.

Therefore upon any appearance of JYJ-relevant topics, the personal judgement of the issue, fans’ and bystanders’ views have to be clearly differentiated. I do not want to simply discuss about JYJ but to direct at the things happening right now and to talk about my views. Therefore before the beginning of discussion of this issue, We have to understand the slight bias that is present in the term ‘idol’.

Preconditional Claim 2: JYJ are wealthy
JYJ have accumulated lots of wealth. This can be known from the assets that were pronounced in news articles. But the main point of the problem is the unfair contract lawsuit between them and SM. Many people think that given the enormous wealth that JYJ had gotten yet the decision to sue the company was nothing different from being a ungrateful betrayer, with the lack of appreciation towards the company’s initial training for them and instead sarcastically said that themselves are slaves. Whether the truth to this is such, I am not in the position to say anything. But this issue is simple, whether their contract is justifiable or not, the court has its judgment. How much has the trio earned as members of TVXQ, there is no way to certify it now. Stealing 50 thousand away from 100 thousand is the same nature as stealing 50 thousand from 1 million. Because to someone who have earned 1 million, losing that 50 thousand, he would still feel unease.

Thus with these two preconditional claims, no matter they are wealthy people or betrayers, there are no basis. “How will the law be judging it?” This is the most important. Therefore before any conclusion is out, there should not be any clear judgment passed on them. Be it from ethical or law point of view, there are a lot of injustice towards the current JYJ. The weirdest that happened in JYJ’s activities was the unability to appear in news articles, television dramas and not able to participate in variety programmes, in addition to the frequent “sudden cancellation without a reason” incidents. The trio of JYJ recorded QTV’s programme in 24 hours and in the end this programme was unable to be broadcasted by QTV itself. Park Yoochun, who was supposed to attend KBS’s Win Win was canceled, together with this time’s “sudden cancellation” of Jeju island promotional performance even though the receipt of the cue sheet.
Not only such, on normal circumstances when a new drama is due to be broadcasted, the cast of the drama would appear in many variety shows for promotional purposes. But in ‘Miss Ripley’ situation, there are no interview of production company’s press conference from the start, and no appearance of the cast appearing on variety shows such as ‘Come To Play’.

Appearing in drama and news but nowhere to be seen in the entertainment circle, this is obviously an incomprehensible issue. Of course there would be such a situation where fans would express that it is the doing of a certain agency preventing the broadcast, but as the “agency” did not reveal anything, there would not be thoughts of accusations or suspect of the certain agency.

On the contrary, I think the problem lies with the broadcasting company. Because the television company or the news agency would invite guests to make their programmes more interesting. As for drama, the cast’s participation in variety shows would definitely allow the drama to be sold overseas with a higher price.

But the situation of Jeju’s promotional performance is completely different. With them being appointed as ambassadors, they have greatly influenced the promotional effects but was yet omitted in performance. The sudden cancellation was incomprehensible, especially when the schedule was already confirmed. There are lots of overseas fans who have planned to fly over to Korea for this public performance and this has worsen the problem. It feels so regretful especially when this happened in national-managed broadcasting company KBS.

Pre-appointed ambassadors scheduled performance was yet suddenly canceled without any special reason, this is obviously an injustice issue. Gaining the promotional effects and omitting them in the end, this shows the vile side of the establishment. This has to be brought up together with the harm inflicted to many fans. This is not what a national-managed television company should do.

The invisible backdoor pressure rumours were unbelievable. It is obvious that there is special reason and this reason have caused the cancellation. Before any judgment by the court is passed, there should not be any obstruction to their entertainment activities. Korea is a lawful country. In Korea, it is unimaginable to know of power who disregard law and there are no way to confirm if such power existed. If they say that there are not outside pressure, then wouldn’t it be impossible to stop the broadcasting based on one’s effort?
Therefore I hoped that KBS television company will give a proper explanation to this sudden cancellation of JYJ’s broadcasting. What is the exact reason for canceling JYJ’s broadcast. I hoped to receive a convincible reason.

Hopefully KBS can relay to the public the message that “Republic of Korea is a lawful society and there are no injustice.” If KBS’s reason is not convincible, that would be very regretful, very pitiful. This proves that under the law of our Republic of Korea, there are still certain power existing or that KBS has to depend on certain establishment’s power to produce programmes. If it is really so, then undoubtedly, JYJ has bear the injustice sacrifice and they have became the symbol of injustice.

110525 JYJ’s Fanclub Draws Attention With Their Satirical Advertisement ‘The Ballads of JYJ’

The advertisement satirizing JYJ’s current situation has become a hot topic.

Titled ‘The Ballads of JYJ’, this front-cover advertisement parodies a Saseolsijo (T/N: a form of a traditional three-stanza Korean poem in which the first two verses are not restricted in length) and creates a satire of the hindrance on JYJ’s freedom to pursue activities by the restrictions on their appearances on music programs.

The Seoul District Courts laid down two verdicts in October, 2009 and in February, 2011 stating that JYJ are granted the freedom to pursue independent activities in the entertainment industry till the end of their lawsuit with SM Entertainment.

However, it is still hard to see JYJ appear on TV and more and more people are beginning to question the reason as to why this is. ‘DNBN’, the fanclub that headed this advertisement’, stated, “We want people to know that JYJ’s independent activities are being blocked for unjust reasons.

JYJ’s domestic and overseas fans have been showing their passionate affection for JYJ as they continue to support the group through advertisements and petitions.

110525 JYJ Japan Charity Concert – Reason Why Event Time Was Revealed But Not Event Location

Only revealing the event date, without a location. This is not a “guerrilla” performance, but an actual performance where tickets have to be purchased.
However, it is currently in a situation which cannot be understood easily. This is the Japanese charity concert of Kim Jaejoong, Park Yoochun and Kim Junsu of JYJ.

JYJ will be holding a charity concert on 7 June. This concert was created in support of victims of the big earthquake that hit Japan in March. However, their management company C-JeS Entertainment has only revealed the event date, and has said nothing about where the concert will be held.

This is what happened. Initially, JYJ, who had broken away from TVXQ, had started selling tickets (for this event) for a concert at Yokohama Arena. However, they suddenly received a notice that they would be unable to perform at Yokohama arena, and the management company switched locations to Saitama Arena.  However, they once again received a notice from the location management dissolving the agreement.

This matter is related to JYJ’ s management company in Japan, Avex Entertainment. Avex, who announced the suspension of JYJ’s activities in October last year, heard about this Charity Concert, and sent a official notice to the locations requesting that they “Do not hold this concert.”

In response to this, JYJ’s management company, together with the charity concert organiser Zak Corporation, filed for a provisional injunction against Avex Entertainment for unfair handling last month at Japan’s Tokyo District Courts.

With their concert venue being coerced into cancellation, the performance would have to be cancelled completely, but the management company has decided to push ahead with the plans to hold the concert.
According to personnel related to JYJ, the concert venue has already been decided. Those who have purchased tickets will be notified of the location soon via SNS. It will not be held at the currently stated arena, and because it will be an outdoor location, audio technicalities may occur, but after consideration of the waiting fans, they have decided to go ahead with this concert.

C-JeS Entertainment, expressed via their Japanese website, that “This concert is not just a one-time event, please take this to be a sign that JYJ will be restarting activities in Japan from now on. Even if the location for this concert may not be the best, please believe in our sincerity, and we hope that everyone will be able to support us.”

On another note, on 7 June at Osaka’s Kyocera Dome, Yunho and Changmin’s TVXQ will be participating in a joint K-Pop concert, incidentally creating a face-off of TVXQ members in Japan.

110519 KBS’ Official Statement, “When JYJ Release A New Song, They Will Be Able To Appear On ‘Music Bank’”

Regarding the restriction placed on JYJ from appearing on KBS 2TV’s ‘Music Bank’, KBS released an official statement on the 19th that read, “When JYJ release a new album, they will be able to appear on Music Bank.” They also said, “The decision to allow JYJ to appear on the show will be made solely by the staff of ‘Music Bank’.”

The KBS publicity team stated that JYJ have not been appearing on ‘Music Bank’ “Because they haven’t released any new songs recently.”

According to the KBS publicity team, the staff can only request the appearance of singers when they release a new song, excluding drama O.S.T.s, but since JYJ have not released a new album since mid-February, they have been unable to appear on ‘Music Bank’.

The team continued to explain that the ‘cut off’ date was set in mid-February for JYJ’s appearances in variety programs such as ‘Music Bank’ as JYJ were locked in a legal dispute with SM Entertainment till this date.
On the 17th of February, the Courts rejected both SM’s formal objection to the partial acceptance of JYJ’s exclusive contract suspension injunction, as well as their own exclusive contract suspension injunction against the contract signed between C-JeS Entertainment and JYJ. The KBS publicity team stated that KBS had done what is usually done and refrained from allowing JYJ to appear on variety programs before this date as these televised appearances may have had an impact on the outcome of the Courts’ verdict.

It was also stated that the ‘Variety Program Sector’s Stance On The Restriction On JYJ’s Appearances In ‘Music Bank’, which was posted in the Viewers’ Thread on the 17th, was deleted on the 18th as, “There was a business error.”

The KBS publicity team stated, “The post in question was a response the variety program sector wrote last February to a question submitted to the Viewers’ Thread but due to a business error (by the Viewers’ Thread staff), the statement was posted much later than it was intended to be, which is why it has been deleted.”

110519 KBS Says, “The JYJ Post Was Written Before February… There Are No Restrictions Against Them”

Regarding the official statement released on the topic of restrictions placed on JYJ, Jeon Jin Gook, the director of KBS’ variety sector, stated on the 19th that, “There are currently no restrictions placed on JYJ in the variety sector of KBS.” Regarding the official statement released by the variety program sector on the 17th, he seemed to be at a loss for words as he said, “That’s from February…”

The director stated that the official statement of the variety program sector, on the controversy surrounding restrictions on JYJ’s televised appearances, was compiled and submitted before February, but seemed to have only just been posted in the Viewers’ Thread on the 17th.

But the response was made to a post made by Ms. A in the Viewers’ Thread on February 25th titled, ‘Please explain why JYJ can’t appear on KBS shows’. KBS took a battering when it was revealed that the official position stated that as JYJ are currently in a lawsuit with SM and as they are tied to a dual-contract, KBS is following the “normal procedure to await the outcome of the situation and to refrain from allowing the celebrity to appear on TV.”

This is because by mid-February, the Courts had already rejected SM’s formal objection to the partial acceptance of JYJ’s exclusive contract suspension injunction, as well as their own exclusive contract suspension injunction against the contract signed between C-JeS Entertainment and JYJ.

JYJ were still unable to appear on variety shows in March. Last March, Park Yoochun was scheduled to appear on KBS’ ‘Kim Seung Woo’s On A Roll’ as Kim Kap Soo’s special guest, but his appearance was suddenly cancelled, sparking rumors of external pressure on the variety program sector.

Director Jeon stated, “The request for and the appearance of JYJ on programs is up to the staff in charge,” and emphasized once more that there are no restrictions whatsoever in the variety program sector against JYJ. He also added, “When JYJ release a new album, wouldn’t that naturally lead to talks of TV appearances with the PDs of their respective programs?

The official statement regarding restrictions on JYJ’s televised appearances on KBS has been deleted from the Viewers’ Thread.

When asked why the post had been removed, a representative of the thread stated, “The content of the official position is currently being revised.”

110519 KBS ‘Buck-Passes’ After Deleting The Controversial ‘JYJ Explanation’

KBS is being scorned by the public for resorting to evasion of responsibility after deleting their official position on the restrictions against JYJ’s televised appearances on its variety programs once the statement was surrounded by controversy.

On the 19th, KBS deleted its official statement on the reason why JYJ (Kim Jaejoong, Park Yoochun, Kim Junsu) are unable to appear on KBS variety programs such as ‘Music Bank’, which was posted on the ‘Viewers’ Thread’ and answered by the staff of the variety program sector.

This deletion seems highly related to the controversy and opposition that arose against the official statement. JYJ’s agency refuted each point made by KBS and JYJ’s fans raised their voices as they said, “This is unacceptable.”

However, KBS is breeding doubt by failing to post an official reply as to why the post was deleted.

In a phone call with Star News, the representative of KBS’ Viewers’ Thread staff did not give a definite explanation and evaded the question as he said, “I think you’ll have to ask that question to the publicity team.”
But as the ‘Response from the Staff’ in question was moderated by the Viewers’ Thread staff, this shows that they have done nothing but evade their responsibilities.

On the homepage itself, the Viewers’ Thread staff have explicitly stated that, “The ‘Response from the Staff’ is a subsection of the ‘Daily Viewers’ Opinions’ in which the Viewers’ Thread staff choose questions submitted by the viewers for the staff in their respective fields to receive and answer in order to strengthen the viewers’ understanding of a certain event or program.”

The KBS publicity team stated, “As this was not an official statement released by the publicity team through the online publicity office, the situation is not one that the publicity team can explain. We are currently investigating the situation.”

This means that the KBS Viewers’ Thread staff have deleted a controversial post without even giving a reason why. We would like to question if ‘buck-passing’ is the best course of action for the KBS Viewers’ Thread at this moment.

Miss Ripley’s Production Company Says, “We Are Curious As To Why Park Yoochun Can’t Appear On Variety Programs”

JYJ have once more been swept up in an external pressure controversy. On the 17th, the press conference for MBC’s ‘Miss Ripley’, the drama in which Park Yoochun plays a leading role, was held yet reporters from MBC’s entertainment news program ‘Section TV Entertainment News’ were not seen, sparking alight the pre-existing rumor that SM Entertainment, JYJ’s former agency, is applying external pressure on the MBC variety program sector. This rumor had already escalated when it was found that Park Yoochun was scheduled to appear on MBC’s ‘Come to Play’ and KBS’ ‘On a Roll’, only to have his appearances cancelled.

In a phone conversation with 10Asia, a representative of ‘Section TV Entertainment News’ stated, “We have a system and criteria set for such news coverage. If there are better items to cover, we do not have to send reporters to a location for the sole reason that the drama is one being aired by our broadcasting company. Recently, we aired a segment focusing on Lee Da Hae of ‘Miss Ripley’, so we decided to exclude the press conference from the list as it overlapped.

However, ‘Section TV Entertainment News’ has attended the press conferences of all MBC miniseries with the exception of ‘Matched Pair’. But ‘Section TV Entertainment News’ focused heavily on ‘Matched Pair’ after the press conference by visiting the filming location of the drama frequently and holding a separate interview with the child actors. The lack of coverage of ‘Miss Ripley’ by MBC has left the production company of the drama with many questions left unanswered.

The production company of ‘Miss Ripley’ stated, “We had no problem adding Park Yoochun to the cast of the drama. We, too, are curious as to why Park Yoochun can’t appear on variety programs.

The rumors of external pressure are also circulating around KBS. KBS recently responded to a viewer who wrote a post in the Viewer’s Thread titled, ‘Please explain why JYJ can’t appear on KBS shows’. According to the response, “As JYJ’s lawsuit with their former agency has not yet ended, KBS is awaiting the results of the lawsuit with the most objective position as possible. The televised appearance of a celebrity locked in a legal dispute, such as a lawsuit, usually has an impact on the controversy that surrounds them. So it is a normal procedure to await the outcome of the situation and to refrain from allowing the celebrity to appear on TV.”
Though the Courts laid down the verdict that JYJ are allowed to temporarily pursue independent activities in the entertainment industry until the final verdict of the lawsuit between the group and SM Entertainment, KBS cannot allow them to appear on their programs as they are currently active under a dual-contract. KBS added that JYJ would not be able to appear on KBS’ programs until the end of the legal dispute.

CEO Baek Chang Joo of C-JeS Entertainment, currently in charge of managing JYJ, has already released an official statement refuting that of KBS.

But Park Yoochun has already appeared on KBS’ ‘SungKyunKwan Scandal’ and JYJ sang that KBS’ ‘Acting Awards’. Therefore, people can’t help but question why JYJ are able to appear on all programs excluding variety shows. Even if the public were to accept KBS’ stance, there is no equity in the notion that the standards of appearing in a variety show and the standards of appearing in a drama are different.

On the other hand, ‘Section TV Entertainment News’ stated, “If ‘Miss Ripley’ becomes very popular, we will become the ones to ask for coverage of their drama.” This means that the success of ‘Miss Ripley’, as well as the response from the MBC variety program sector, may be what will confirm or deny the rumors of external pressure. Will JYJ be able to appear on variety programs?

110518 JYJ Request An Apology From KBS “Did We Ever Cause Problems In Society?”

C-JeS Entertainment has released an official position refuting the stance released by KBS on the 18th.

Through the official statement, CEO Baek Chang Joo of C-JeS Entertainment stated, “Regarding the lawsuit that KBS has deemed an issue, the Courts laid down the verdict that SM’s subordinate contract is one-sided and unjust last year, deeming it no longer valid.”

He continued to state, “Also, in February, the Courts recognized that SM was interfering with JYJ’s activities, leading to a strict order being laid down upon them. Therefore, KBS’ claim does not make sense as its statements are not in accordance with each other.

He also added, “A verdict was made that SM must no longer interfere with the activities JYJ pursue with C-JeS under their contract,” and “These artistes are fighting a lonely battle against a prominent entertainment agency for the sole purpose of gaining a just contract.

CEO Baek stated, “We believe it is not right for KBS, instead of maintaining an objective stance on the issue, to express its official position in a way that suggests that JYJ have caused problems in society to the public, who do not know much of the issue. Therefore, we request that KBS rectify their errors.”

Lastly, CEO Baek said, “Recently, JYJ have been chosen as honorary ambassadors for publicity projects led by the nation and various groups and have been enhancing national prestige. Therefore, it saddens us to see that others are claiming that JYJ are disrupting the order of the cultural industry.”

110518 KBS Releases Its Official Position, “The Reason JYJ Can’t Appear On Music Bank..

Broadcasting company KBS has released its official position on JYJ’s appearances on KBS TV shows.

On May 18th, the official position of KBS was released in response to the post titled ‘Please explain why JYJ can’t appear on KBS shows’ on the KBS Online Office Staff’s Replies thread.

The KBS variety program sector stated, “As JYJ’s lawsuit with their former agency has not yet ended, KBS is awaiting the results of the lawsuit with the most objective position as possible. The televised appearance of a celebrity locked in a legal dispute, such as a lawsuit, usually has an impact on the controversy that surrounds them. So it is a normal procedure to await the outcome of the situation and to refrain from allowing the celebrity to appear on TV.”

They continued to state that the dual-contract controversy was a main factor in their decision as they stated, “JYJ submitted an exclusive contract suspension injunction against their former agency, and they have been granted temporary independent activities in the entertainment industry till the verdict of the lawsuit. However, JYJ have signed a contract with their current agency and are currently promoting their album under a dual-contract.”

They also added, “These reasons have led KBS to conclude that continuous televised appearances by JYJ will lead to legal problems as well as a possibility of impeding the growth and order of the cultural industry. Until the final verdict of the legal dispute between JYJ and their agency is laid down, or until the lawsuit is ended through a settlement, KBS will refrain from allowing JYJ to appear on KBS’ shows and will only proceed to request their appearance once this has happened, taking into consideration the outcome of the lawsuit as well.

This signifies that KBS has perfectly clarified all baseless rumors of external pressure on the broadcasting company.

This official position was written in response to a post submitted by Ahn Eun Young in the KBS Viewers’ Thread. Ms. Eun Young stated, “I would like to question why singers JYJ cannot appear on KBS programs and why their album has been excluded from the K-Chart. Though the lawsuit between them and SM has not ended, the Seoul District Courts stated on February 17th that, ‘SM can neither administer limits through their exclusive contact nor impose superintendency on JYJ’s activities in the entertainment industry’ and rejected SM’s application, meaning that the Seoul District Courts do not see any problems with JYJ’s activities in the industry.”

She also added, “I would like to know why JYJ are able to appear on KBS’ other programs but have been barred from appearing KBS’ music program. I hope to see an official position from the staff of KBS with the exact reason as to why the appearance of JYJ on the show as well as the K-Chart is being withheld.”

110517 The Empty Space Left Behind By The Mighty TVXQ Is Too Big To Fill… SM’s Performance ‘Plummets’

It has been found that the stocks of the listed entertainment management enterprise SM did worse in the first quarter of this year than last year with a sudden 6~8% drop.

Much attention has been drawn to this issue as some are speculating that this drop in SM’s business showings since last year is a result of the reduced number of activities by ‘TVXQ’, who acted as SM’s cash cow.

TVXQ was most active in Japan in May~June, 2009, resulting in a higher amount of income. This income then went through a ‘division of income’ process (approximately 6 months) with the Japanese agency and was mostly added to the first quarter of last year, which explains why the results for this year’s first quarter are so low.

YoungWoong Jaejoong, Xiah Junsu and Micky Yoochun, no longer a part of the team after filing a lawsuit against their agency due to problems with their exclusive contract, have now formed the group ‘JYJ’ and those remaining, U-Know Yunho and Choikang Changmin, have decided to continue their activities under the name TVXQ.

SM released their quarterly report on the 16th which stated that the enterprise’s first quarter net sales, business profits and net profits were 19.3 billion Won, 2.3 billion Won and 1 billion Won respectively. Last year’s first quarter net sales, business profits and net profits were 22.6 billion Won, 10.2 billion Won and 8.5 billion Won respectively. Their business profits have reduced by 80% in a matter of one year.

Analyst Lee Sang Hyun of Hi Investment Bonds said, “In the case of SM, an enterprise in the entertainment management industry, there is no need for ‘an alternation of joy and grief’ in their quarterly results,” and “In the case of their Japanese profits, which make up the largest portion of the enterprise’s yearly sales, the profit from the sales of albums and concerts are taken in by SM after an estimated six-month delay according to their contract with their Japanese counterpart.”

He continued to say, “It is true that SM’s first quarter results have significantly reduced relative to last year due to the fact that the profits from TVXQ’s activities two years ago contributed to last year’s first quarter results,” and “But Girls’ Generation have released their ‘Mr. Taxi’ album last month and are scheduled to perform in four cities while SHINee are experiencing high popularity and interest as well, meaning that we can expect a visible improvement in the near future.”

SHINee’s ‘Replay’ album, set to release on June 22nd in Japan, has already become the most reserved album on online sites such as HMV and Tower Records.

The analyst also added, “Of the 10 billion Won that SM earned in net profits in the first quarter of 2010, approximately 8 billion Won came from net profits earned by TVXQ which shows that Japanese sales have a great impact on SM’s net profits,” and “As the influence of K-POP strengthens in Japan, Girls’ Generation has begun their activities in Japan, meaning that we can expect a visible improvement in the near future.”

He also said, “The second quarter will be better than the first quarter, and the second half of the year will see an increase in overseas royalties.”

110519 JYJ Junsu Faces KBS Broadcast Restrictions, “Happy Even With Only Fans’ Trust”

“Even if there is only trust, I am still happy”

On the 18th this month, KBS released an official statement through the KBS Online Office’s message board regarding JYJ being unable to appear on broadcast programmes.

KBS Entertainment Bureau expressed their own stand on the issue, “The continuous problem of JYJ being unable to appear on broadcasts, as well as the legal issues, shows the definite risk of adversely affecting the development and order of the cultural industry. This is the reason why they are unable to have any broadcast appearances before the legal dispute between JYJ and their entertainment company comes to an end via compromise or through a final judgement. We will decide on future appearances based on the verdict of the lawsuit.”

On the 19th, JYJ member Kim Junsu posted words of gratitude to fans on his personal Twitter in relation to this event. He said, “When I woke up this morning, I saw this kind and that kind of news appear…! We just have to work even harder ^^ You know this right!? Do not be sad..”

Afterwards he continued to thank, “There will be a day where we will be understood and trusted ^^ Until that moment comes, if we do not give up on each other, even if we only have that (trust) we will be happy~ I am always thankful to all of you!”

At the same time, fans replied with words like “We are happy just being able to listen to you sing”, “Because of your positive thinking, fans are gaining strength too” among others.

On another note, JYJ plans to hold their North American Tour consecutively in 4 cities, starting on the 20th in Vancouver, Canada, following with New Jersey on the 22nd, Los Angeles on the 27th, and San Jose on 2nd June.

110520 Fans condemn Korean TV station for banning boy band JYJ

MANILA, Philippines — Korean TV station KBS is getting the heat from international fans of JYJ including Filipinos after it released a statement to justify why it continues to ban the boy band from appearing on its shows.

“We–as international consumers of the Korean Wave, supporters of JYJ and citizens of the world that value justice and the rule of law–hereby condemn the official statement issued by Korean Broadcasting System (hereafter, ‘KBS’) on 18 May, 2011 regarding its reasons to prohibit JYJ from appearing on ‘Music Bank’ and other such entertainment programs,” according to a petition issued by JYJ fans in the Philippines, Germany, Malaysia, Turkey, Finland, United Kingdom and Europe.

The statement stemmed from a message posted by KBS on its message board regarding JYJ.
JYJ and SM Entertainment are currently involved in a court case that dates back to 2009 when Xiah Junsu, Micky Yoochun and Kim Jaejoong, members of popular group TVXQ, sued the agency to annul their exclusive contracts.

The three left SM Entertainment and TVXQ and have since formed their own group, JYJ. The three have been banned by Korean TV stations from appearing on their shows especially the music shows because of the lawsuit.

A Korean court issued an injunction ordering SM Entertainment not to meddle with JYJ’s activities. Fans are waiting for the final decision of the court on the lawsuit.

In its message, KBS said it continues to ban JYJ because of the lawsuit, adding that allowing JYJ to appear on shows can influence the outcome of the case. It also said that it cannot allow JYJ to appear on the shows because the group is currently promoting their albums under two contracts—one from SM Entertainment and another one from C-JeS Entertainment, the agency hired by the three to manage their careers.

It added that JYJ’s TV appearances are a “threat to the culture industry.”

In their statement, the fans said, “Ultimately, any attempt by KBS to use the exclusive contract and the lawsuit between JYJ and SM Entertainment as a justification for prohibiting JYJ’s media appearances run contrary to the explicit mandate of the Court and is a mischaracterization.”

KBS took down the message the following day, saying that the statement was an old message that was written last February in response to a question on the message board. It claimed that the posting of the May 18 statement was a system error so it was deleted.

It also claimed that JYJ was not invited to perform on “Music Bank” because the group hasn’t released an official album and only released official soundtracks. However, fans pointed out that JYJ has indeed released an album, “The Beginning”, last year contrary to KBS’ claim.

KBS said when JYJ releases an album, it will depend on the producer of “Music Bank” on whether to invite JYJ or not.

“We look forward to KBS honoring its commitment to broadcast JYJ on Music Bank when the group’s new album is released,” the fans said.

“Music Bank” is one of the music TV shows that K-pop artists appear on to promote their music. Others are SBS “Inkigayo”, MBC “Music Core” and Mnet “M! Countdown.”

JYJ is currently on World Tour. They will hold a concert at Rogers Arena in Vancouver, Canada on May 20 (May 21 in the Philippines). The group will also hold concerts on May 22 in Newark, New Jersey; Nokia Theatre L.A. Live in Los Angeles, California on May 27 and at the Event Center of the San Jose State University in San Jose, California on June 3.

KBS, can they keep their promise with JYJ?

The ironical situation of Park Yuchun’s casting in MBC drama “Miss Ripley” and his inability to appear on MBC entertainment programs at the same time… the situation arising from KBS’s restraint of letting JYJ on broadcasts… amongst Korean idols, there isn’t anyone who has as many controversies as JYJ.'

There isn’t a single musical program who will allow JYJ to stand on stage, and although they say there aren’t any restrictions, we also cannot find programs trying to let JYJ on the air.

There isn’t direct evidence for the claim that SM Entertainment, JYJ’s ex-management company, has pressured the broadcasting companies in any way. However, it’s also true that all broadcasting companies are reluctant to allow JYJ, the group at the center of the controversy, on stage.

JYJ is being reviewed as having proposed a new model for idols. Unlike other idols who set their looks at their head, [JYJ] have set their singing abilities as their foundation and their performances and singing have achieved  steady improvement. Furthermore, each member’s musical capabilities are also excellent and thus the members are showing off their abilities in songwriting, and they are being recognized as real artists beyond idol singers, with JYJ’s Kim Jaejoong even acting as the director for the World Tour.

Furthermore, recently Kim Junsu’s version of “That Man” had caught great attention, and despite the Karaoke accompaniment, Kim Junsu’s unique voice, different from Baek Jiyoung, the original singer of the song, and Hyun Bin from drama “Secret Garden,” was prominent.

However, we cannot see such singers, considered to be one of the best in terms of singing ability amongst idols, in music programs. This can only be a loss for the viewers. The viewer’s demand is to allow JYJ to stand in the music programs and at least give them a chance to compete.

Just in time, on the controversy of problems with JYJ’s appearance on “Music Bank,” KBS revealed, “on the production’s standard that an artist’s appearance is determined by the release of their albums, JYJ, who has not released an album since the court’s decision on February 17th, was not a candidate for appearing [in our program]. The selection of the singers is the inherent right of the production staff, and the production staff will determine their appearance according to JYJ’s album release and activities in the future.”

With this, JYJ has earned the chance to quiet the controversy over the restrictions they’ve faced in appearing [on broadcasts]. Currently, JYJ has began its World Tour in North America with four new songs, and ending their World Tour in June with their concert in Busan. If JYJ releases an album with their new songs then, KBS will have to decide on their appearance according to the appearance criteria they have just announced.

It’s difficult to determine the success and failure of JYJ, who has left their ex-management company SM ENT, with their activities up until this point. You cannot say that JYJ has failed without giving them a chance  to stand on stage.

If JYJ’s music is below standard, there shouldn’t be a need to specifically block their activities. The greatest restriction in activities is the public not listening to a singer’s songs.

Therefore, [no one] should deprive the public of their right to judge JYJ’s music. Furthermore, we must keep in mind that the danger of hampering the growth of cultural industry, which KBS has referred to, is NOT because of JYJ’s appearance on broadcasts, but because of unfair opportunities.

JYJ released official press release in response to KBS’s official stance on MAY 19, 2011.

We appreciate that KBS officially stated its stance saying that JYJ will be able to appear on Music Bank when JYJ release an official album. According to recent cases, it is inevitable that artists are in inferior positions when a broadcast company refuses appearances on TV regardless of what the reason may be.

In Feb, the court acknowledged that SM interfered in JYJ’s album release by sending official document to Warner Music, production label of JYJ, and ordered SM to pay compensation for the interference. In the view of these facts, there still are many obstacles stading in JYJ’s way to release an official album. [Translator's Note: In Oct 2010, SM sent an official document to Warner Music, asking not to distribute JYJ's worldwide album <The Beginning>.]

But we will overcome this invisible external pressure for our fans waiting for us and release an official album. With this, we hope that we will meet the viewers via Music Bank.

And regarding the present situation, the issue is not only about JYJ’s appearance but also about the inappropriate post on a public online forum that damages JYJ’ name. Therefore we request that KBS rectify this in order to minimize misunderstanding that the post may ensue.

110519 KBS explains why they deleted their statement regarding JYJ’s broadcast appearances

Shortly after the release an official stance by KBS on the exclusion of JYJ from music show broadcasts and variety show programs on May 18th, JYJ’s agency, CJES Entertainment fired back with a heated response, claiming that their statements did not match up with the current situation. KBS had since deleted their post from their official site, which brought upon further speculations amongst fans.

-

The next day, KBS’s promotional team explained that their official statement was actually an outdated statement that was written back in February as a response to a question that was posted on their bulletin board that asked about JYJ’s lack of broadcast appearances.

KBS’s promotional team explained, “The statement was a reply to a question that our help desk received back in February, but because of a certain service error, the response was posted late, which is why we took it down shortly after.”

KBS also came forth to explain that the only reason why JYJ have not yet appeared on “K-Chart” or performed on “Music Bank” was simply because JYJ hadn’t released a new single or album since February.
They stated, “The group has only been releasing OSTs, not official albums. When they do release official albums, a decision on whether they will appear on broadcast will be made by the show’s producer.”

-
In contrast to KBS’s statements though, JYJ did indeed release an official album back in 2010, titled “The Beginning“, and also unveiled a ‘music essay’ back in January 2011.

So why weren’t JYJ able to perform their songs on “Music Bank”?

In the case of their music essay, it was categorized and sold as an ‘essay’ rather than a single or album. As it was considered more of a book rather than music, “Music Bank” had not taken their sale aggregations into consideration.

But in the case of “The Beginning”, the album has it clearly written on its cover, “First Worldwide Full Album“, and was even properly distributed by Warner Music.

JYJ’s agency stated, “The album ‘The Beginning’, was sold properly via a legit distribution company. However, we have never been notified by the broadcasting company regarding what measures or actions to take in order to be included in aggregation calculations for their charts. Moreover, there has never been a time when we asked why JYJ haven’t been able to appear on broadcasts. Protests that are written up on KBS’s viewers’ discussion board are not our official statements, but the opinions of the netizens.”

110518 JYJ’s agency deems KBS’s statement as illogical

Following the release of KBS’s statement addressing JYJ’s exclusion on their programs, JYJ’s agency were quick to fire back at the broadcast station, deeming their excuse as “illogical“.

On May 18th, CJES Entertainment rebutted, “The lawsuit about JYJ’s subordinate contract with SM Entertainment that KBS was referring to was already acknowledged by the court as lopsided and disadvantageous to JYJ, and the contract was subsequently nullified.”

In addition, last February, the invalidity of their contract with SME was emphasized once more as the court declared another order for SME to stop indirectly impeding on JYJ’s activities. With these being said, we believe KBS’s stance does not match up with the facts.”

They continued, “When SM Entertainment lodged a lawsuit regarding the ‘dual contract’, the court rejected their argument and ordered SM to not interfere with JYJ’s activities with CJES Entertainment. Considering JYJ’s lonely fight against such a huge agency in request for a more reasonable contract, we believe it is wrong that KBS is deviating from the objective truth and making the public think that JYJ are just creating more societal problems. We strongly request for them to make corrections on their part.”

“Especially with JYJ currently participating in overseas promotional projects with various countries, as well as being appointed highly ranked ambassadors, we’re very disappointed that they are speaking of JYJ as threats to the culture industry,” concluded CJES Entertainment.

110518 KBS releases official statement regarding JYJ’s broadcast appearances

KBS has released an official statement regarding their decision to bar JYJ from appearing on their broadcasts.

The statement was posted on KBS’s online production crew message board as a response to the many requests asking for the reasons why JYJ was not allowed to make an appearance.
KBS explained,
JYJ’s lawsuit has yet to come to an end and KBS is taking note of this lawsuit from an objective standpoint… From a business perspective, allowing a celebrity who is in the midst of a legal dispute onto a broadcast can have an influence on the current situation. Therefore, it is common to refrain their appearances while waiting for the results of their legal dispute.

Though it appears that JYJ has submitted a request to nullify their exclusivity contract with their existing agency, they made their own judgment to temporarily participate in activities on a case-by-case basis. However, JYJ has signed with another agency and are currently continuing their album promotions under two contracts.
Because of these issues, KBS has decided that currently, JYJ’s broadcast appearances may bring about legal problems and is threat to the culture industry. Until JYJ comes to a settlement or agreement with their agency, we will refrain from their broadcasts as a whole. Casting and guest appearances will be made depending on the outcome.
The post has since been removed while JYJ’s agency has countered with their own statement.
